1. Respect for Intellectual Property Rights

DVDFab respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). We expect our users to use our services responsibly and in accordance with applicable laws.

It is our policy to respond promptly to clear notices of alleged copyright infringement. While we do not actively monitor user activity on their local devices, we do not endorse or support the use of our software for any illegal activities, including the unauthorized distribution of copyrighted content.

2. Nature of Our Services (Important Clarification)

Please Note: DVDFab provides local software tools for personal backup and format conversion.

  • No Content Hosting: We do not host, store, or index any copyrighted media files (movies, music, videos) on our servers.
  • User-Generated Actions: Any downloading, copying, or conversion is performed locally on the user's device. The user bears full responsibility for the content they process using our tools.
  • Search Engine Disclaimer: If our website provides links to third-party websites, we have no control over the content of those sites and assume no responsibility for their materials.

3. Reporting Copyright Infringement (DMCA Notice)

If you are a copyright owner or an agent thereof, and you believe that any content hosted on the DVDFab website (e.g., text, images, forum posts) infringes upon your copyrights, you may submit a notification pursuant to the DMCA.

To be effective, the notification must be in writing and include the following information:

  1. Identification of the Work: A description of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the Material: A description of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, along with information reasonably sufficient to permit us to locate the material (e.g., the specific URL).
  3. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  4. Statement of Good Faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Designated DMCA Agent

5. Counter-Notification

If you believe that your content was removed (or access to it was disabled) as a result of a mistake or misidentification, you may send a counter-notification to our Copyright Agent. The counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the court for the judicial district in which your address is located (or standard jurisdiction if outside the US).

6. Misrepresentations

Please be aware that under 17 U.S.C. § 512(f), you may be liable for any damages, including costs and attorneys’ fees incurred by us or our users, if you knowingly materially misrepresent that material or activity is infringing. If you are unsure whether the material you are reporting is in fact infringing, you may wish to contact an attorney before filing a notification with us.

7. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, DVDFab has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
